Florida Summer Fertilizer Blackout Rule Reference

Why this matters

On top of the state baseline, more than 100 Florida counties and municipalities have adopted local ordinances that further restrict fertilizer application during the summer rainy season - the "fertilizer blackout" period. A lawn care firm operating in Florida needs to know the state rule, the county rule, and the city rule for every job site, because the local rule often supersedes the state rule and the fines are stacking.

The state baseline rule

Florida Administrative Code 5E-1.003 (Labeling Requirements for Urban Turf Fertilizers) sets:

  • Maximum nitrogen application rate: 1 lb of soluble nitrogen per 1,000 sq ft per application; 4 lbs of total nitrogen per 1,000 sq ft per year for established lawns; rates vary by grass species.
  • Slow-release nitrogen requirement: at least 50% of the nitrogen in any urban turf fertilizer sold in Florida must be slow-release.
  • Phosphorus restriction: no phosphorus may be applied to established lawns unless a soil test demonstrates phosphorus deficiency.

The blackout period

The local-government fertilizer blackout is the rule that catches operators by surprise. Most Florida counties and cities in the Gulf Coast, Atlantic Coast, and Central Florida watersheds have adopted ordinances prohibiting nitrogen and phosphorus fertilizer application during the summer rainy season - typically June 1 through September 30, though dates vary by jurisdiction.

The state has not adopted a uniform blackout. The Florida legislature in 2023 considered, then declined, statewide preemption of local fertilizer ordinances. As of 2025 the legislative environment shifted toward state preemption discussions but the local rules remain in force pending future legislation.

Counties and cities with blackout periods

The following jurisdictions have well-documented summer fertilizer blackouts as of the 2024 to 2025 review cycle (verify current text with the local jurisdiction before scheduling work):

  • Pinellas County: June 1 to September 30 blackout on nitrogen and phosphorus.
  • Sarasota County: June 1 to September 30.
  • Manatee County: June 1 to September 30.
  • Lee County: June 1 to September 30.
  • Charlotte County: June 1 to September 30.
  • Collier County: May 31 to October 1.
  • Martin County: June 1 to September 30.
  • Indian River County: June 1 to September 30.
  • St. Lucie County: June 1 to September 30.
  • Hillsborough County: June 1 to September 30 with limited exceptions.
  • Tampa, St. Petersburg, Naples, and many other municipalities have city-level ordinances that mirror or extend the county rule.

What is restricted during the blackout

A typical Florida blackout ordinance prohibits, during the blackout period:

  • Application of any fertilizer containing nitrogen on established lawns.
  • Application of any fertilizer containing phosphorus on established lawns (separately from the year-round phosphorus restriction).
  • Application of fertilizer within 10 to 15 feet of any water body, regardless of season.
  • Application of fertilizer on impervious surfaces or directly before a forecast rain event over 2 inches.

Exemptions typically include:

  • Application of micronutrients only (iron, manganese) where labeled.
  • Application to athletic fields under a documented turfgrass management plan.
  • Application to new landscapes under documented establishment phase.
  • Application by a state-certified applicator with documented agronomic justification (rare and not a routine exception).

Penalties

Local blackout ordinances are enforced by code enforcement at the city or county level. First offenses typically issue warnings; repeat offenses escalate to per-occurrence civil fines (typical ranges in Florida ordinances are $50 to $500 per first violation, scaling to $1,000+ on repeat violations). Some jurisdictions can also issue cease-and-desist orders on commercial applicators and refer repeated violators to the FDACS for action against the applicator certificate.

Applying nitrogen or phosphorus fertilizer during a local blackout window is a code enforcement violation in the ordinance-adopting jurisdiction. The fines stack per address and per visit. Customers will sometimes ask for application during the blackout - the answer is no, and the firm carries the liability if the application happens regardless of customer request.

What can be applied during the blackout

Many blackout ordinances allow iron-only applications for color (no nitrogen), manganese for deficiency, composted organic soil amendments that do not meet the regulatory definition of "fertilizer" under state law, lime for pH adjustment, and herbicide and fungicide applications (those are pesticide rules, not fertilizer rules). Verify each product's label against the local ordinance definition before applying during a blackout.

The county-by-county workflow

For every Florida customer, the firm's job-intake checklist includes:

  1. Pull the county and city of the service address.
  2. Look up the current fertilizer ordinance for both jurisdictions.
  3. Document the blackout window and any property-specific buffer or setback requirements.
  4. Schedule fertilizer applications outside the blackout window.
  5. Schedule micronutrient and pesticide work during the blackout only if specifically permitted by the local ordinance.
  6. Train every applicator on the ordinance variations across the firm's service area.

Applicator certification

Every commercial fertilizer applicator in Florida must hold a Limited Urban Commercial Fertilizer Applicator Certificate from FDACS under FAC 5E-14.117. The certificate requires a six-hour Green Industries Best Management Practices (GI-BMP) training course and exam, and renews every four years with continuing education. Document the certificate number for every applicator on the firm's roster.
