Post-Construction First-Clean Liability Disclaimer SOP

Why this matters

Post-construction window cleaning is the single highest-claim job in the trade. Razor scrapers on tempered glass that contains nickel-sulfide fabrication defects produce micro-scratches the cleaner did not cause and cannot prove they did not cause. General contractors who hired the cleaner shift the entire scratched-glass bill onto the cleaner's certificate of insurance without a fight. This SOP gives the inspection, the disclosure form, and the contract clauses that keep a major IGU-package replacement off your loss run.

The scratched-glass problem

Tempered glass passes through a furnace and a quench during fabrication. If a nickel-sulfide (NiS) inclusion is present, surface micro-fissures and stress concentrations can form. When a metal scraper (the standard tool for removing construction film, paint specks, mortar splash, and silicone overspray) runs across the surface, it can drag debris embedded in the glass and produce visible scratches that read as cleaner damage. The damage was latent; the scraping made it visible. The customer sees only the scratches and the cleaner.

Industry guidance (CRL / National Glass Association) is consistent: razor scraping on tempered glass should be the last resort, not the default, and the cleaner must inspect and document before scraping.

Pre-job inspection (before any tool touches glass)

Complete this walk before signing the work order:

  1. Walk every elevation with a flashlight at a 30-degree raking angle.
  2. Photograph each pane, with date and elevation label.
  3. Mark any pre-existing scratches, chips, spider cracks, edge fractures, or fabrication defects on a building plan.
  4. Identify tempered units - look for the bug etched in a corner per ANSI Z97.1 / 16 CFR 1201.
  5. Identify coated units - low-E and reflective coatings restrict tool choice. Check the spacer bar for coating-orientation markings.
  6. Identify the construction debris type per elevation: stucco / mortar splash, paint specks, silicone overspray, adhesive labels.

Customer / GC disclosure form

Have the homeowner and / or general contractor sign before the first scrape:

  1. The cleaner has identified [list of glass types] including tempered units that may contain fabrication defects beyond the cleaner's control.
  2. Industry practice permits the use of razor scrapers to remove construction debris, but scraping any glass carries a small risk of revealing latent defects.
  3. Pre-existing damage is documented in the attached photo log.
  4. The cleaner is not responsible for scratches, fissures, or breakage caused by fabrication defects, post-installation handling by other trades, or weather events occurring after the inspection date.
  5. Claims of damage must be reported within 7 calendar days of completion and verified against the photo log.

This form is the difference between a defensible position and a settle-because-it's-cheaper position.

Scraping technique that minimizes risk

When scraping is unavoidable:

  1. Use a fresh blade for every elevation. A dulled blade drags rather than cuts and is the single most common scratch cause.
  2. Wet the glass first with a generous flood of soapy solution. Dry scraping is not acceptable on any glass.
  3. Hold the blade at 30 degrees to the glass surface, push in one direction only, and lift on the return stroke.
  4. Replace the blade at the first sign of resistance, snag, or visible debris on the cutting edge.
  5. Never scrape over a visible inclusion, defect, or edge - work around it with chemistry instead.

Chemistry alternatives

When scraping risk is too high (tempered, coated, or visible inclusions), use chemistry:

  1. Construction adhesive and silicone: D-limonene or citrus-based solvent, dwell 5 to 10 minutes, agitate with a soft brush, rinse.
  2. Mortar / concrete splash: dilute phosphoric acid, dwell 2 to 5 minutes, rinse aggressively, neutralize.
  3. Paint overspray: methylene-chloride-free paint remover with a poly scraper (not metal).
  4. Stucco residue: rinse with clean water first to soften, then mild acid as a follow-up.

Insurance and contract setup

Three contract conditions before accepting a post-construction job:

  1. Verify the GC's COI lists the cleaner as additional insured for the project duration - this routes claims through their carrier, not yours.
  2. Add a scratched-glass exclusion to your work order: "Damage attributable to fabrication defects, prior trades, or latent conditions is excluded from cleaner liability."
  3. Confirm your own general liability and any glass-rider coverage. Post-construction risk can exceed standard liability sub-limits; some carriers exclude or sub-limit scratched-glass claims. Read the policy before bidding.

Never accept payment release that waives all claims unless the GC has signed the post-job inspection sign-off with the photo log attached. A waiver without the documented inspection record can be voided by the homeowner against the cleaner directly even after the GC has paid.

Post-job walk

Immediately after completion:

  1. Walk every elevation with the GC superintendent or owner present.
  2. Re-photograph any panes flagged during pre-inspection.
  3. Sign and date the post-job inspection form noting "no new damage observed" or list any items.
  4. Hand the customer the photo log on USB or shared drive and keep a copy for 7 years (the typical statute of limitations on construction-defect claims runs that long in many states).
