Neglect or Defect: Who Bears the Cost Decision Tree
Why this matters
Every failed part sits on one side of a line: it broke because it was made wrong, or it broke because of how it was installed, used, or maintained. Which side it lands on decides who pays. Call a defect "neglect" and you bill a customer for a warranty claim that should have cost them nothing, and you burn trust you will not get back. Call neglect a "defect" and you eat the cost yourself, or worse, you file a warranty claim that gets denied after you have already told the customer it is covered. This tree is the order you check things in so the call is defensible, not a guess.
Start here: do not decide before you look
The instinct on arrival is to pattern-match fast: "these things always fail" or "customers never maintain these." Both instincts are wrong often enough to burn you. Before you say a word to the customer about cause, gather the physical evidence in the next three sections. Only then do you talk fault.
Step 1: Check the failure point against known defect signatures
Manufacturing defects tend to look a specific way, and the pattern repeats across trades:
- A single component fails while everything around it is clean and undamaged. A capacitor that bulges on a unit with no other heat or moisture history. A fitting that cracks along a molded seam with no impact marks. A control board with one failed trace while the rest of the board is pristine.
- The failure follows a known batch or lot pattern. If you have seen the identical failure on multiple units of the same age and installation type, with no common install error, that points to the part, not the field.
- The damage is internal and consistent with a material or assembly flaw - a weld that never fully penetrated, a seal that was pinched during assembly, a winding that shorted from day one with no evidence of overheating from outside causes.
- The failure happened early in the service life, especially inside the manufacturer's stated warranty window, with no unusual operating history.
If the failure matches this pattern and you find no contributing external cause, treat it as a probable defect and follow the manufacturer's warranty claim process before charging the customer anything.
Step 2: Check for the physical signs of neglect
If the defect signature above is absent, look for neglect markers instead. These are documented in more depth elsewhere (see related), but the short list:
- Debris, buildup, or restriction upstream of the failed part - a clogged filter, a blocked vent, scale buildup, dirt packed into a component that needed airflow or clearance.
- Damage consistent with external force - impact marks, a bent bracket, crushed insulation, evidence the unit was moved or struck.
- Signs of skipped maintenance - a filter that has clearly never been changed, a lubrication point that is bone dry, a component that shows the specific wear pattern of running dirty or dry for an extended period.
- Evidence the system was operated outside its rated conditions - overloaded, run past a rated duty cycle, exposed to conditions the unit was never designed for.
If you find these markers and they plausibly caused or accelerated the failure, this leans neglect, and the customer bears the repair cost.
Step 3: The failure can be both, and that is common
Do not force a binary answer when the evidence does not support one. A part with a genuine manufacturing weakness can fail years sooner than it should have because of neglect, and a well-maintained system can still have a defective part. When you see contributing factors on both sides:
- Document both findings honestly.
- Explain to the customer that maintenance likely shortened the life of a part that also had a flaw, and that this usually means a shared outcome, not a clean bill either way.
- If a warranty claim is in play, let the manufacturer's inspection make the final call rather than asserting it yourself. You report what you found; you do not have to be the final arbiter of a warranty dispute you cannot fully resolve on your own.
Step 4: Photograph and document before you touch anything further
Whichever way this leans, your case is only as strong as your evidence:
- Photograph the failed part in place, before removal, from multiple angles.
- Photograph any contributing damage or buildup separately and clearly.
- Note the unit's service history if you have access to it (prior visits, filter changes, prior repairs).
- Write down exactly what you observed in plain language, not conclusions. "Filter was compacted with debris, no airflow through the media" is defensible. "Customer never maintained this" is an opinion you cannot prove.
This documentation is what protects you if the customer disputes the charge, and it is what a manufacturer needs if you are filing a warranty claim on the defect side.
Step 5: Have the conversation last, not first
Once you have the evidence, talk to the customer plainly:
- If it is a defect: "This looks like a manufacturing issue, not anything you did. I am filing a warranty claim and will keep you posted."
- If it is neglect: show them what you found, in plain terms, before naming the cost. "This filter has not been changed in a long time and it choked off airflow to this part, which is why it failed early. That is what caused today's repair." Showing the evidence lands better than asserting the verdict.
- If it is genuinely mixed: say so. Customers respect a straight answer more than a verdict that conveniently always favors the shop.
