Commercial Fluorescent Tube and Ballast PCB Disposal per RCRA

Why this matters

A commercial lighting retrofit can generate hundreds of 4 ft and 8 ft fluorescent tubes plus a stack of magnetic ballasts in one truckload. The tubes carry mercury vapor (regulated as universal waste under 40 CFR 273); the ballasts manufactured before 1979 carry PCB capacitors (regulated under TSCA at 40 CFR 761 as PCB items). Both have outright disposal bans in most landfills. Mixing them, breaking the tubes, or dropping a leaking ballast in a dumpster turns a routine job into a state DEQ enforcement action with statutory civil penalties up to 37,500 dollars per day per violation under 40 CFR 19.4 (TSCA). The driver is liable; the company is liable; the building owner may be liable as the original generator. Run the SOP and the paperwork or do not take the work.

Scope and applicability

This SOP applies to:

  • Fluorescent tubes (T5, T8, T12, U-bend, circline) containing mercury vapor
  • Compact fluorescent lamps (CFL) and high-intensity discharge (HID) lamps including metal halide, high-pressure sodium, and mercury vapor lamps
  • Lighting ballasts manufactured before July 2, 1979 (typically marked "Contains PCBs" or unmarked from that era)
  • Capacitors from light fixtures and motor starters of the same era

This SOP does NOT apply to LED tubes or LED drivers; LED is non-hazardous and goes to standard e-waste channels per local rules.

Identification at the job site

Lamps

Assume every fluorescent or HID lamp contains mercury until proven otherwise. EPA-compliant low-mercury "TCLP Pass" tubes (Philips ALTO, Sylvania ECOLOGIC, GE Ecolux) are still hazardous under most state rules even though they pass the federal TCLP test; manage them as universal waste regardless.

Ballasts

Pull a sample ballast and check:

  1. Manufacturer date code. Pre-1979 manufacturing date is presumptive PCB.
  2. Label. "No PCBs" is the post-1979 manufacturer attestation. Absence of "No PCBs" on an old ballast is presumptive PCB.
  3. Capacitor visible? A leaking capacitor (oily residue, tar drip) is presumptive PCB and a TSCA spill under 40 CFR 761.125 if released to a non-impervious surface.

EPA "Ballast Identification" guidance (2010) is the field reference. When in doubt, treat as PCB and ship to a TSCA-permitted facility.

Packaging

Lamps (universal waste)

Per 40 CFR 273.13(d) and 273.33(d):

  • Containers must be structurally sound, compatible with contents, and lack evidence of leakage. Original lamp cartons or commercial lamp boxes (sealed cardboard with internal sleeves) are acceptable.
  • Containers must be closed except when adding or removing lamps.
  • Containers must be labeled "Universal Waste Lamps" or "Waste Lamps" or "Used Lamps" with the accumulation start date.
  • Federal universal waste rules allow accumulation up to 1 year from the start date.
  • Broken lamps require a sealed plastic-bag-lined drum and labeling as "Universal Waste Broken Lamps". Some states (California, New York) require broken lamps to be managed as fully hazardous waste, not universal waste.

Ballasts

  • Non-leaking PCB ballasts: package in DOT-rated UN/1A2 steel drums or UN-rated fiber drums with absorbent liner. Label "PCB Ballasts" with the accumulation start date.
  • Leaking PCB ballasts: overpack in a UN-rated salvage drum (1A2 steel or 1H2 plastic) with absorbent (vermiculite, oil-dry) to fill voids. This becomes a TSCA PCB Item and must ship on a Uniform Hazardous Waste Manifest (EPA Form 8700-22).
  • Non-PCB ballasts: still contain di-ethyl-hexyl-phthalate (DEHP) potting compound which is a hazardous waste under California and some other state rules. Ship to e-waste or scrap-metal recycler.

A leaking PCB ballast on a porous surface (concrete, soil, wood) is a TSCA spill requiring cleanup, characterization, and notification to EPA within 24 hours per 40 CFR 761.125. Do not move the ballast and do not wipe up the spill with a rag that then goes in your truck. Stop, contain with absorbent in place, document with photos, and call a TSCA-permitted spill responder. Civil penalty exposure under 40 CFR 19.4 reaches 37,500 dollars per day per violation.

Transport

Universal waste lamps in compliant packaging are not subject to DOT hazmat shipping rules under 49 CFR 173.157 (limited quantity provision). PCB ballasts above 50 ppm in a "PCB Item" container are RQ hazmat and require:

  • DOT-compliant marking: UN3432 (PCBs, Solid) or UN2315 (PCBs, Liquid) as applicable
  • Uniform Hazardous Waste Manifest (EPA Form 8700-22)
  • The transporter must hold a state hazardous waste transporter permit
  • The receiving facility must be permitted under 40 CFR 761.60

Documentation

For every commercial lighting cleanout job, retain for 3 years (universal waste) or 3 years (TSCA PCB):

  1. Site description and quantity of lamps and ballasts collected
  2. Container photos with accumulation start date labels
  3. Bill of Lading or Manifest for each shipment
  4. Receiving facility's Certificate of Recycling or Certificate of Destruction
  5. Customer transfer-of-custody signature

Universal waste handlers under 40 CFR 273.32 must keep a log of every shipment received and sent for 3 years. Large quantity handlers (over 5,000 kg accumulated at any time) must notify EPA on Form 8700-12.

Disposal channels

Lamps go to a mercury reclamation facility (Veolia, Stericycle Environmental, AERC). Ballasts go to a PCB-permitted facility (Veolia Port Arthur, Clean Harbors Aragonite, EnviroSafe Heidelberg). Confirm the facility's EPA ID number and TSCA permit number before the first shipment. Get the Certificate of Destruction back inside 30 days; tickle the file.
